The Texas Court of Appeals (9th District) has overruled a Motion for Reconsideration in Brunson vs. Life Forms Homes, preserving its earlier ruling that EIMA is not subject to jurisdiction in Texas.

The motion was filed by Life Forms Homes, the defendant homebuilder, on Aug. 12 and overruled on Aug. 15. The appeals court will now issue a mandate directing the trial court in Brunson to dismiss EIMA from the case.

EIMA will now ask that it be dismissed from the four remaining Texas cases involving EIMA on the basis of the Court of Appeals decision in Brunson.

In other association news, EIMA announced that its restructured Web site is up and running. The site incorporates a number of new components, including a password-protected Members Only section and pages geared exclusively to four gatekeeper audiences—real estate and insurance professionals, home inspectors and building officials.

Access the site by logging on to EIMA’s current URL, www.eima.com, but a member ID and password to enter the Members Only area is required.

The expanded site will be periodically updated with new information from the executive director’s office, meeting notices, EIMA position statements, expert commentary, EIMA newsletters, and published articles that support the association’s position on important industry issues.
